ECL Mediation Privacy Policy

General Data Protection Regulations (GDPR)

ECL Mediation is registered with the ICO. We take your privacy seriously and follow all relevant guidelines. More detail is set out below

How we receive your information
From our website: you may choose to provide us with personal information when you access our website; we may also ask you to provide certain information about yourself including your name, title, postal address, telephone number, email address etc

Automatically: we may collect information automatically about your usage of our website using cookies (also known as browsers or tracking cookies) and other technology. To this end, we use your IP address to collect, amongst other things, internet traffic data and data regarding your browser type and computer. If you don’t wish to receive cookies, you may reject them by using your browser settings provided they are not necessary for effective delivery of our website or services

For mediation work: for the purposes of providing estimates of costs, or initial or further advice as a client of ECL Mediation, we will need certain information to confirm your identity, date of birth, contact information for you and other participants, or other information as part of your instructions to us

​From third parties: we may also receive information about you from third parties such as solicitors, accountants, banks, regulatory bodies or other advisors / specialists related to the mediation matter

How we use this information
We will only use your information for the purpose for which it has been provided or collected by us, including
  • To provide information you may request about the services we offer
  • To contact you to introduce our mediators
  • To provide our clients with mediation services, or where requested by you, to refer you to other specialists, advisors or mediators
  • To comply with our statutory and regulatory obligations
  • To verify your identity and check background circumstances for anti-money laundering and other authentication purposes
  • To deal with feedback, queries or complaints
  • If you become a client of ECL Mediation, to invite you to hospitality events or send you information which we believe may be of interest to you. You are entitled to require us to remove your details from any marketing lists

Basis for processing your information
We must have a lawful basis for processing your information, which may vary as to the circumstances of why and how we have your information, but examples include:
  • Activities within our legitimate interests as mediators offering our services to prospective and actual clients
  • You have provided your consent for us to process your information, for example in relation to marketing activities
  • We are performing necessary steps in relation to a contract to which you are party or prior to you entering a contract
  • We are processing information necessary for compliance with our legal obligations, including for example anti-money laundering requirements which may include carrying out electronic ID checks
  • To protect your interests
If we process any specific information relating to racial, ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, genetic data, processing of biometric or health data, or sexual orientation, we will obtain further lawful basis, such as explicit consent, unless:
  • You have already made the information public, or
  • The information is necessary for:
- legal defence
- preventing unlawful acts
- complying with regulatory requirements
- dealing with suspected terrorist financing or money laundering
- obtaining legal advice 

Disclosure of your information
Some of the information you provide us will be held on our computers in the UK and will only be accessed by our staff working in the UK
We may also transfer your information to other organisations or professional advisors with whom we are working on client matters or where we are referring you for additional advice. We may also be obliged to disclose data under certain laws or by order of the courts or other competent regulatory body or may be permitted to disclose it under applicable data protection laws

Protection of your information
We have in place measures designed to guard against and minimise the risk of loss, misuse or unauthorised processing or disclosure of personal information we hold
Where we transfer information to third parties to enable them to process it on our behalf, we will ensure providers meet or exceed the relevant legal or regulatory requirements for transferring data to them and keeping it secure. All third parties are subject to confidentiality obligations that form part of our contractual relationship with them. We will keep your personal information no longer than is necessary for the purpose for which it was collected
